Terms of Service

1. Acceptance of Terms

By accessing and using PixGuard ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use the Service.

2. Service Description

PixGuard provides automated image copyright risk detection services using a multi-stage AI pipeline including:

• Perceptual hashing (pHash, aHash, dHash) against a database of reference image fingerprints, mostly from public collections such as Wikimedia Commons
• AI image models: CLIP on every plan, plus DINOv2 and SSCD similarity matching on Pro and Business
• Visible watermark, text and logo detection for major stock agencies, using computer vision and OCR
• EXIF, IPTC and XMP metadata analysis, and reading C2PA Content Credentials when present
• Detection of likely AI-generated images
• On Pro and Business, an AI vision review of borderline images
• On Pro and Business, source lookup that shows web pages where a matching image appears

Additional Services:

• Free Check: Without an account, check up to the 3 largest images on a single page you enter, up to 3 times a day. The free check runs a smaller set of checks than account scans
• Site Monitoring: Scheduled re-scans of your site with an email summary of risky images (Pro: weekly, up to 3 sites. Business: daily or weekly, up to 10 sites)
• Source Lookup: On Pro and Business, for higher-risk images, shows web pages where a matching image appears and a likely source. It does not confirm who holds the rights or what license applies
• Risk Inbox: Mark flagged images as resolved or licensed, or generate a DMCA takedown-notice template (see Section 7)

Important Disclaimer: Our scans are NOT 100% accurate. While we employ advanced detection methods with high accuracy rates, copyright detection is inherently complex and our results should be used as guidance only, not as definitive legal evidence. Always consult with a legal professional for copyright matters.

3. User Accounts and Registration

The free check and free tools work without an account. To create a PixGuard account, you must:

• Sign in with a Google account (sign-in is handled by our authentication provider, Clerk)
• Provide accurate and complete information
• Maintain the security of your account credentials
• Be at least 18 years old or have parental consent
• Not use the service for illegal purposes

4. Credits and Payments

Credit System:

• 1 credit = 1 image analysis (new images only)
• Cached images (previously analyzed) are FREE - 0 credits
• New users receive 30 free credits once, at signup. Signups with a disposable email address receive no free credits
• Free signup credits expire 30 days after signup. Purchased image packs do not expire. Subscription credits refresh each month, unused subscription credits do not roll over, and they end when your subscription ends
• Credits are non-transferable

Subscription Tiers:

• Free: approximately 30 image scans, granted once at signup (not monthly) and valid for 30 days. No card required
• Pro ($29/month or $290/year): approximately 250 image scans/month, weekly monitoring of up to 3 sites, source lookup and AI vision review
• Business ($79/month or $790/year): approximately 1,000 image scans/month, daily or weekly monitoring of up to 10 sites, source lookup, AI vision review and priority processing
• Image packs (one-time): 85, 270, 750 or 1,700 image scans for $20, $60, $150 or $300. Pack credits do not expire

Payments:

• Processed securely through Paddle (Merchant of Record)
• All prices in USD
• Refunds available within 14 days (see Refund Policy)
• Payment processing fees charged by our payment provider are non-refundable where permitted by applicable law. Approved refunds are issued net of these fees, unless we choose to absorb them and issue a full refund as a goodwill gesture at our discretion.
• We reserve the right to change pricing with 30 days notice

5. Acceptable Use Policy

You agree NOT to:

• Upload illegal, harmful, or infringing content
• Abuse or attempt to circumvent our credit system
• Reverse engineer or scrape our service
• Use automated tools to access the service without permission
• Resell or redistribute our services
• Use the service to harass, spam, or harm others
• Violate any applicable laws or regulations

6. Site Monitoring and Alerts

Pro and Business subscribers may enable monitoring: scheduled re-scans of a website with an email summary of risky images. Pro can monitor up to 3 sites weekly. Business can monitor up to 10 sites daily or weekly. By using this feature:

• You confirm you have authorization to scan the websites you monitor
• Monitoring scans consume credits from your balance
• A scheduled scan is skipped if your credit balance is below 10 credits
• The email summary (and a webhook, if you set one up through the API) covers images at or above your configured severity threshold
• We are not liable for missed alerts, delayed scans, or webhook delivery failures
• Monitoring subscriptions are automatically deactivated if your plan is downgraded below the required tier

7. Risk Inbox and Takedown Templates

PixGuard offers these tools for handling flagged images:

• Risk Inbox (paid plans): Lists high-risk findings from your website scans. You can mark an image as resolved or licensed, which hides it from your inbox. This does not change anything on your site, and the image may still be flagged in future scans
• Takedown template: Generates a DMCA takedown-notice template and links to where notices can be filed

PixGuard does not replace, blur, or remove images on your site. Takedown templates are a starting point, not legal advice. You are responsible for checking that any notice you send is accurate and that you have the right to send it.

8. Limitation of Liability

IMPORTANT:

• PixGuard results are NOT legal advice
• We are not liable for copyright infringement by users
• Results should not be solely relied upon for legal decisions
• Our service is provided "AS IS" without warranties
• We are not responsible for false positives or false negatives
• Maximum liability limited to amount paid in last 12 months

9. Data, Privacy, and Analytics Consent

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your data.

Image Data:

• Images are analyzed and hashed for caching purposes
• We do not keep the original image files. We store image fingerprints (hashes and, on Pro and Business, AI embeddings), analysis results, and the image URLs found in website scans
• For images you upload in the dashboard, we also store a preview copy (resized to at most 800 pixels) that is shown in your history for 3 days
• Analysis results are cached and reused so repeat checks of the same image cost 0 credits, including when another user checks the same image
• The free check without an account deletes images after analysis and saves nothing to an account
• You can request deletion of your data at any time

Analytics Consent: By creating an account and accepting these Terms, you consent to the use of analytics and advertising technologies (PostHog, Microsoft Clarity, Google Analytics, Google Tag Manager, and the Google Ads and Microsoft Advertising tags) for behavioral analytics, heatmaps, session replay, and measuring our ads. For visitors without an account in the EU, EEA, UK, and Switzerland, these tools load only after you accept our cookie banner. For visitors without an account in other countries, no banner is shown and these tools load by default. See our Cookie Policy for details.

10. Intellectual Property

All content, features, and functionality of PixGuard (including but not limited to software, text, graphics, logos, and ML models) are owned by PixGuard and protected by copyright, trademark, and other intellectual property laws.

11. Termination

We reserve the right to:

• Suspend or terminate your account for violations
• Remove content that violates these terms
• Discontinue the service with 30 days notice

You may terminate your account at any time by contacting support. Unused credits are non-refundable unless otherwise specified in our Refund Policy.

12. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of significant changes via email or through the service. Continued use after changes constitutes acceptance of the new terms.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PixGuard operates, without regard to its conflict of law provisions.
