Terms of Service

1. Acceptance of Terms

By accessing and using PixGuard ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use the Service.

2. Service Description

PixGuard provides automated image copyright risk detection services using a multi-stage AI pipeline including:

• Perceptual hashing (pHash, aHash, dHash) against a database of 500,000+ known images
• AI embeddings (CLIP + DINOv2) for visual similarity matching
• Stock image database matching (Shutterstock, Adobe Stock, Getty)
• Reverse image search integration (Google, TinEye, SerpAPI)
• Watermark and overlay detection via computer vision
• EXIF/C2PA metadata analysis
• VLM-based copyright risk assessment

Additional Services:

• Site Monitoring: Recurring website scans (daily/weekly) with email and webhook alerts for new or changed risky images (Pro and Business plans)
• Auto-Remediation: Replace risky images with safe alternatives, apply blur, or generate proper attribution (1 credit per action)
• Source Attribution: Identify the original source, photographer, and license type of detected images

Important Disclaimer: Our scans are NOT 100% accurate. While we employ advanced detection methods with high accuracy rates, copyright detection is inherently complex and our results should be used as guidance only, not as definitive legal evidence. Always consult with a legal professional for copyright matters.

3. User Accounts and Registration

To use PixGuard, you must:

• Register using Google OAuth authentication
• Provide accurate and complete information
• Maintain the security of your account credentials
• Be at least 18 years old or have parental consent
• Not use the service for illegal purposes

4. Credits and Payments

Credit System:

• 1 credit = 1 image analysis (new images only)
• Cached images (previously analyzed) are FREE - 0 credits
• Auto-remediation actions (replace, blur, attribute) cost 1 credit each
• New users receive 100 free credits upon signup
• Credits never expire
• Credits are non-transferable

Subscription Tiers:

• Starter (Free): 100 credits/month
• Pro: 500 credits/month + site monitoring (up to 3 sites) + source attribution
• Business: 2,000 credits/month + site monitoring (up to 10 sites) + source attribution + priority processing

Payments:

• Processed securely through Paddle (Merchant of Record)
• All prices in USD
• Refunds available within 14 days (see Refund Policy)
• We reserve the right to change pricing with 30 days notice

5. Acceptable Use Policy

You agree NOT to:

• Upload illegal, harmful, or infringing content
• Abuse or attempt to circumvent our credit system
• Reverse engineer or scrape our service
• Use automated tools to access the service without permission
• Resell or redistribute our services
• Use the service to harass, spam, or harm others
• Violate any applicable laws or regulations

6. Site Monitoring and Alerts

Pro and Business subscribers may enable recurring website monitoring. By using this feature:

• You confirm you have authorization to scan the websites you monitor
• Monitoring scans consume credits from your balance
• Scans may be skipped if your credit balance is insufficient
• Email and webhook alerts are sent based on your configured severity threshold
• We are not liable for missed alerts, delayed scans, or webhook delivery failures
• Monitoring subscriptions are automatically deactivated if your plan is downgraded below the required tier

7. Auto-Remediation

PixGuard offers automated remediation actions for flagged images:

• Replace: Suggests royalty-free alternatives from Unsplash and Pexels
• Blur: Applies a blur filter to the flagged image
• Attribute: Generates proper attribution text for licensed images

Replacement images are sourced from third-party platforms and are subject to their respective licenses. PixGuard does not guarantee the copyright status of replacement images. You are responsible for verifying the license terms of any replacement image before use.

8. Limitation of Liability

IMPORTANT:

• PixGuard results are NOT legal advice
• We are not liable for copyright infringement by users
• Results should not be solely relied upon for legal decisions
• Our service is provided "AS IS" without warranties
• We are not responsible for false positives or false negatives
• Maximum liability limited to amount paid in last 12 months

9. Data, Privacy, and Analytics Consent

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your data.

Image Data:

• Images are analyzed and hashed for caching purposes
• We store image hashes (not full images) in our database
• Analysis results are stored to improve service quality
• You can request deletion of your data at any time

Analytics Consent: By creating an account and accepting these Terms, you consent to the use of analytics technologies (including Microsoft Clarity) for behavioral analytics, heatmaps, and session replay. For anonymous visitors who have not created an account, analytics are only loaded upon explicit consent via our cookie banner. See our Cookie Policy for details.

10. Intellectual Property

All content, features, and functionality of PixGuard (including but not limited to software, text, graphics, logos, and ML models) are owned by PixGuard and protected by copyright, trademark, and other intellectual property laws.

11. Termination

We reserve the right to:

• Suspend or terminate your account for violations
• Remove content that violates these terms
• Discontinue the service with 30 days notice

You may terminate your account at any time by contacting support. Unused credits are non-refundable unless otherwise specified in our Refund Policy.

12. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of significant changes via email or through the service. Continued use after changes constitutes acceptance of the new terms.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PixGuard operates, without regard to its conflict of law provisions.
